While we await any attempt to force us into imprisonment as we excise civil disobedience against Apartheid “Residenzpflicht”, we shall embark on a Tour all over Germany to damask the repressive policies against Refugees in Germany.

The Tour will serve as a platform for exchange amongst Refugees with a critical view to the 2015 deceptive Asylum “relief” in comprehensive relation to the horrific Asylum “Compromise” of 1993 up to the hypocritical decision of the German Federal Constitutional Court in 2012.

In this tour, refugees will be informed about the “Adverse faces of Germany” enforced through arbitrary powers at different levels, the system of Refugee Isolation and control, the continuous exploitation of Refugees here and beyond the borders of Europe. Their propaganda is built on the grounds of ignorance of a “civilized” society and at the expense of Refugee’s human dignity.

Now is the time to mobilize Refugee’s solidarity and empower networking within our communities through the intimate understanding that we all face the same problems – even though the situations might appear to be different.

Our experiences have confirmed that nothing good can be expected from Imperialist States like Germany except by direct confrontation and scandal.

As your responsibility to support the revolution of the oppressed you should mobilize refugees and organize discussion events in your region. Announce your dates so as to enable us plan our schedule. We will be glad to join you for exchange.

Refugees from Schwäbisch Gmünd on civil disobedience against imprisonment, Restriction of Movement and refugee persecution in Germany

We fled from persecution from our various home countries but still the same persecution continues in Germany. We refugees arriving in Germany are already criminalized at the borders by forceful finger printing before our names are even known.
Our political protest started in February 2014 when we discovered the violation of our privacy by being exposed to CCTV camera observation (Close Circuit Tele Vision) that had been installed at the entrance of the isolated refugee Lager in Schwäbisch Gmünd without prior notification. We sent an inmate delegate to the responsible authorities to let them know how we feel about the CCTV camera positioned opposite the entrance of the lager. We stated that it gives us the precarious impression to be held under surveillance control which makes us feel to be prisoners in fear and insecurity to scare us from Self-Organization in the isolated refugee Lager. But the district officials of Schwäbisch Gmünd refused to accept our demand for the removal of the CCTV camera…

Wir nehmen es nicht hin, dass Memedovichs aus ihrem Zuhause gerissen werden sollen, als Familie nicht zusammen bleiben dürfen und gezwungen werden, zurück in unzumutbare Lebensumstände zu gehen. Es ist nicht akzeptabel, dass Menschen still und heimlich vom Staat deportiert werden und kein Recht auf ein selbstbestimmtes Leben haben sollen. Menschen müssen das Recht haben, sich aussuchen zu dürfen, wo sie leben!

Die im Verfahren gegen Mbolo Yufanyi Movuh wegen Widerstandshandlungen gegen Polizeibeamte und versuchter Gefangenbefreiung zuständige Richterin Marieluis Brinkmann beschneidet den Angeklagten in seinen Rechten, gängelt das interessierte Publikum, bemuttert einen mutmaßlich gewalttätigen Polizeizeugen mit schützender Hand und verweigert schließlich die unverzügliche Unterbrechung der Beweiserhebung zur Stellung eines Befangenheitsantrages seitens des anwaltlichen Verteidigers.

 

 

Das Verfahren gegen Mbolo Yufanyi Movuh wurde am 26. September eröffnet, weil er am 15.10.2012 in Berlin bei den Protesten gegen die Zusammenarbeit der nigerianischen Botschaft mit dem deutschen Staat bei der Abschiebung von Flüchtlingen teilgenommen hat und ihm o.g. Gleich zu Beginn des ersten Verhandlungstages ergriff der für alle diese Verfahren anklagende Staatsanwalt Markus Winkler das Wort, noch bevor der Angeklagte seine Eingangserklärung überhaupt beenden konnte und forderte von der Richterin Marieluis Brinkmann durchzusetzen, dass im Zuschauerraum absolutes Stillschweigen durchgesetzt werden müsse. Dabei verwies er auf vorherige Verfahren, in denen es seiner Meinung nach bereits zu „Störungen“ seitens der Prozessbeobachter gekommen sei und deswegen nun jede noch so leise Meinungsbekundung (insbesondere zu seinen Äußerungen!) doch möglichst bereits im ‚Keim‘ verhindert werden müssten. Frau Brinkmann ließ diese rechtswidrige Unterbrechung der Ausführungen des Angeklagten unkommentiert zu, trotz des Hinweises der Verteidigung, dass der Großteil der stattfindenden Flüstergespräche im Zuschauerraum Übersetzungen für Beobachter bzw. Erläuterungen für neu hinzugekommene Beobachter waren.

Resistance against Rascism and colonial injustice despite judicial
Arbitrariness

In the case against Mbolo Yufanyi Movuh for acts of resistance against
police officers and an attempted liberation of prisoners, the judge in
charge, Marieluis Brinkmann, curtails the defendant’s rights , steers
the interested audience, mothers and protects an alleged violent police
witness, and finally refuses to interrupt the hearing of evidence in
order to file a challenge on grounds of bias on the part of the
defending lawyer.

The case against Mbolo Yufanyi Movuh was opened on September 26th
because he took part in the protests against the cooperation of the
Nigerian Embassy with the German government concerning the deportation
of refugees on the 15th of October 2012 in Berlin and because of the
accusations by police officers displayed above (call for process

place on the 14th and 28th of October 2013 (short process report:

Right at the beginning of the first day of the trial the prosecutor in
charge of all the concerned procedures Attorney Mark Winkler chimed in
before the accused finished his opening statement and called the judge
Marieluis Brinkmann to enforce silence in the courtroom. He referred to
previous cases in which, according to him, there already had been
„perturbances“ by the monitoring audience, so that even the most silent
expressions (in particular those reacting to his comments!) should be
prevented from radically. Ms. Brinkmann left this illicite interruption
uncommented, despite the advocate’s mention that the majority of the
occurring whisper conversation were translations for observers or
explanations for newly arrived observers.
